Welcome to SpamRescue. These Terms of Service ("Terms") govern your use of the SpamRescue website and service (the "Service") operated by Studio Eleven SARL ("we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Please read these Terms carefully before using SpamRescue.

"Service" refers to the SpamRescue website and application.

"User" refers to any individual who accesses or uses the Service.

"Account" refers to the unique account created for you to access our Service.

"Subscription" refers to any paid plan (Pro or Business) that provides access to premium features.

"Content" refers to any information, data, or material processed through the Service.

"Lead" refers to an email identified by our AI as a potential business opportunity.

Account Creation:

• You must provide accurate and complete information when creating an account

• You must be at least 16 years old to use the Service

• You are responsible for maintaining the security of your account

• You must notify us immediately of any unauthorized access

Account Responsibilities:

• You are responsible for all activities that occur under your account

• You may not share your account credentials with others

• You may not use another person's account without permission

• One person may not maintain multiple free accounts

Gmail Connection:

• You authorize us to access your Gmail spam folder through Google OAuth

• You can revoke this access at any time from your Google account settings

• We only access your spam folder; we do not access other folders

SpamRescue provides the following services:

Core Features:

• Automated scanning of your Gmail spam folder

• AI-powered detection of potential business leads

• Lead scoring and categorization

• Email notifications for detected leads

What We Do:

• Analyze email metadata (sender, subject, date)

• Generate AI summaries for detected leads

• Send notifications based on your preferences

What We Don't Do:

• Store full email content

• Access your inbox or other folders

• Send emails on your behalf

• Modify or delete your emails

Service Availability:

• We strive for 99.9% uptime but do not guarantee uninterrupted service

• We may perform maintenance with reasonable notice

• Features may be modified or discontinued with notice

Free Plan:

• Limited features as described on our pricing page

• No payment required

• May be subject to usage limits

Paid Subscriptions:

• Billed monthly or annually as selected

• Prices are in EUR and include applicable taxes

• Payment is processed securely by LemonSqueezy

Billing Terms:

• Subscriptions auto-renew unless cancelled

• You will be charged at the start of each billing period

• Price changes will be notified 30 days in advance

Cancellation:

• You may cancel your subscription at any time

• Access continues until the end of the current billing period

• No partial refunds for unused time

Refund Policy:

• 30-day money-back guarantee for first-time subscribers

• Contact support@spamrescue.io to request a refund

• Refunds are processed within 5-10 business days

You agree to use SpamRescue only for lawful purposes. You may not:

Prohibited Activities:

• Use the Service for any illegal purpose

• Attempt to gain unauthorized access to our systems

• Interfere with or disrupt the Service

• Reverse engineer or decompile the Service

• Use automated tools to abuse the Service

• Resell or redistribute the Service without permission

Content Restrictions:

• You may not use the Service to process illegal content

• You are responsible for complying with email laws (CAN-SPAM, GDPR)

• You must have proper consent to contact leads

Rate Limits:

• Respect the scanning limits of your plan

• Do not attempt to circumvent usage restrictions

• Excessive automated requests may result in suspension

Our Property:

• The Service, including its design, features, and content, is owned by Studio Eleven SARL

• Our trademarks, logos, and brand elements are protected

• You may not use our intellectual property without written permission

Your Data:

• You retain ownership of your email data

• You grant us a limited license to process your data to provide the Service

• This license terminates when you delete your account

Feedback:

• Any feedback or suggestions you provide may be used by us without obligation

• We may implement improvements based on user feedback

Service "As Is":

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

No Guarantee of Results:

• We do not guarantee that all leads will be detected

• AI accuracy may vary; false positives and negatives may occur

• Lead scores are estimates, not guarantees of quality

Third-Party Services:

• We are not responsible for third-party services (Google, LemonSqueezy)

• Third-party service outages may affect our Service

Email Delivery:

• We are not responsible for emails that remain in spam

• Detection depends on email content and our AI capabilities

Limitation:

To the maximum extent permitted by law, Studio Eleven SARL shall not be liable for:

• Any indirect, incidental, special, or consequential damages

• Loss of profits, revenue, or business opportunities

• Loss of data or business interruption

• Any damages resulting from use or inability to use the Service

Cap on Liability:

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Exceptions:

These limitations do not apply where prohibited by law or in cases of gross negligence or willful misconduct.

You agree to indemnify and hold harmless Studio Eleven SARL, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service

• Your violation of these Terms

• Your violation of any third-party rights

• Any content you process through the Service

• Your violation of applicable laws or regulations

By You:

• You may terminate your account at any time from your settings

• Termination takes effect immediately

• Your data will be deleted according to our Privacy Policy

By Us:

• We may suspend or terminate your account for Terms violations

• We may terminate with 30 days notice for any reason

• We may terminate immediately for serious violations

Effect of Termination:

• Your right to use the Service ends immediately

• Paid subscriptions are not refunded upon termination for cause

• Some provisions of these Terms survive termination

Changes:

• We may modify these Terms at any time

• Material changes will be notified via email or in-app notification

• Changes take effect 30 days after notification

Continued Use:

• Continued use after changes constitutes acceptance

• If you disagree with changes, you must stop using the Service

Review:

• We encourage you to review these Terms periodically

• The "Last updated" date indicates the latest revision

Governing Law:

These Terms are governed by the laws of France, without regard to conflict of law principles.

Dispute Resolution:

• Any disputes shall be submitted to the exclusive jurisdiction of the courts of Lyon, France
